F\u00fc\u00fcsilisest isikust ostjal ei ole kohustust ostetav kinnisasi koheselt p\u00f5hjalikult \u00fcle vaadata, puudus v\u00f5ib ja reeglina ilmnebki alles asja kasutusele v\u00f5ttes, nt remondiga alustades.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-229f676 elementor-widget elementor-widget-text-editor\" data-id=\"229f676\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Riigikohus on selgitanud, et \u201eKorteriomandi notariaalselt t\u00f5estatud m\u00fc\u00fcgilepingusse on otstarbekas, vajalik ning aus lisada punktid selle kohta, millised puudused m\u00fc\u00fcjale teadaolevalt korteriomandil on. Notarid peaksid t\u00f5estamisseaduse \u00a7-st 18 tuleneva selgitamiskohustuse t\u00e4itmisel tehingu pooltele mh selgitama, et korteriomandi majandamise asjaolud on olulised ning lepingus tuleks kirjeldada korteriomandi m\u00fc\u00fcjale teadaolevad puudused.\u201c<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c19907 elementor-widget elementor-widget-text-editor\" data-id=\"8c19907\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Riigikohtu arvates v\u00f5ib ka m\u00fc\u00fcgikuulutuses esitatud teave kujutada endast m\u00fc\u00fcgieseme kokkulepitud omadusi. Kui m\u00fc\u00fcgikuulutuses esitatu ei vasta t\u00f5ele, tuleb sellele lepingus t\u00e4helepanu juhtida v\u00f5i v\u00e4hemalt sellest selgelt ostjale teatada.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41db32b elementor-widget elementor-widget-text-editor\" data-id=\"41db32b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Puudused ei ole piiratud ainult eluruumidega, vaid ka kaasomandi m\u00f5ttelise osaga ning ka elukeskkonnaga tervikuna, v\u00e4hemalt l\u00e4hi\u00fcmbruses. Samuti on puuduseks mittetoimiv korteri\u00fchistu v\u00f5i k\u00e4rarikkad naabrid.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2c2cf87 elementor-widget elementor-widget-text-editor\" data-id=\"2c2cf87\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Vanade majade puhul oleks otstarbekas m\u00e4rkida m\u00fc\u00fcgilepingus, et esineda v\u00f5ivad erinevad puudused ja kui ostja ikkagi tahab osta sellist ajahamba poolt puretud asja, v\u00e4listada \u00f5iguskaitsevahendite kasutamine puuduste ilmnemisel. Seda eriti siis, kui m\u00fc\u00fcja ei ole ise m\u00fc\u00fcdavat kinnisasja kasutanud (nt p\u00e4randvara) ja ei ole teadlik asja tegelikust
