Kui aga elades oma uues kodus juba kuid v\u00f5i paar aastat, ja siis \u00e4kki avastad, et naabrimehe k\u00f6himine kostab sisse v\u00f5i aken laseb tuult l\u00e4bi, on tegemist k\u00fcll pahatahtlikkusega.<\/p><p>Kes siis ikkagi vastutab? M\u00fc\u00fcja?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c3c8e4 elementor-widget elementor-widget-text-editor\" data-id=\"3c3c8e4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><a href=\"https:\/\/www.riigiteataja.ee\/akt\/961235\" target=\"_blank\" rel=\"noopener\">V\u00f5la\u00f5igusseadus<\/a> \u00fctleb \u00fcheselt, et m\u00fc\u00fcja vastutab asja lepingutingimustele mittevastavuse (edaspidi puudus) eest, kui mittevastavus on olemas juhusliku h\u00e4vimise ja kahjustumise riisiko \u00fclemineku ajal ostjale, isegi kui puudus ilmneb hiljem.<\/p><p>M\u00fc\u00fcja ei vastuta asja puuduse eest, kui ostja lepingu s\u00f5lmimisel puudusest teadis v\u00f5i pidi teadma.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-229f676 elementor-widget elementor-widget-text-editor\" data-id=\"229f676\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Riigikohus on selgitanud, et lepingutingimustele mittevastavused ehk puudused v\u00f5ivad olla:<\/p><ul><li>puudused, mida on v\u00f5imalik avastada korrap\u00e4rase \u00fclevaatamise k\u00e4igus ja<\/li><li>varjatud puudused, mis ilmnevad m\u00f5ne aja m\u00f6\u00f6dudes peale asja kasutusse v\u00f5tmist.<\/li><\/ul><p>Seega on \u00fclioluline, et m\u00fc\u00fcja k\u00f5ik olemasolevad ja v\u00f5imalikud puudused ostjale ette n\u00e4itab.<\/p><p>Hea oleks, kui need puudused ka m\u00fc\u00fcgilepingusse k\u00f5ik kenasti kirja pandaks. Sellisel juhul vabaneb m\u00fc\u00fcja vastutusest.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8c19907 elementor-widget elementor-widget-text-editor\" data-id=\"8c19907\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Kui aga j\u00e4tta ostjat teavitamata v\u00f5i hiljem ikkagi mingi puudus leitakse, saab ostja n\u00f5uda:<\/p><ul><li>puuduse k\u00f5rvaldamist,<\/li><li>kahju h\u00fcvitamist,<\/li><li>ostuhinna alandamist v\u00f5i<\/li><li>olulise puuduse korral ka lepingust taganeda.<\/li><\/ul><p>Kohtupraktikat on selles valdkonnas palju ja sageli j\u00e4\u00e4b m\u00fc\u00fcja kaotajaks pooleks.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-41db32b elementor-widget elementor-widget-text-editor\" data-id=\"41db32b\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Mida aga teha siis, kui tegemist on n\u00e4iteks sada aastat vana majaga, mille m\u00fc\u00fcja sai p\u00e4randuseks ja ei ole selles kunagi elanud ning ei tea maja seisukorda?<\/p><p>Sellisel juhul v\u00f5ib kokkuleppel ostjaga puuduse avastamisel eelpoolnimetatud \u00f5iguskaitsevahendite kasutamise v\u00e4listada.<\/p><p>Siiski ei ole k\u00f5ik nii roosiline. Seadusega on s\u00e4testatud, et kokkulepe on t\u00fchine, millega v\u00e4listatakse vastutus v\u00f5i piiratakse seda kohustuse tahtliku rikkumise puhuks, samuti kokkulepe, mis v\u00f5imaldab v\u00f5lgnikul t\u00e4ita kohustuse oluliselt erinevana v\u00f5lausaldaja poolt m\u00f5istlikult eeldatust v\u00f5i mis muul viisil ebam\u00f5istlikult v\u00e4listab vastutuse v\u00f5i piirab
