Seda kas hooletusest, raha puudusest v\u00f5i pahatahtlikult.<\/p><p>Mida siis teha?<\/p><p>\u00dc\u00fcrilepingut s\u00f5lmides v\u00f5tab \u00fc\u00fcrnik kohustuse tasuda \u00fc\u00fcri ja teisi asja kasutamisega seotud makse kogu \u00fc\u00fcrilepingu kehtivuse aja jooksul.<\/p><p>\u00dc\u00fcrniku toimetulekuraskused ei vabasta teda tasu maksmise kohustusest ja \u00fc\u00fcrileandja ei ole sotsiaalabi pakkuja. Samuti ei vabasta pandeemiaga kaasnevad piirangud rahaliste kohustuste t\u00e4itmisest.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c3c8e4 elementor-widget elementor-widget-text-editor\" data-id=\"3c3c8e4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Kui \u00fc\u00fcrnik j\u00e4\u00e4b v\u00f5lgu \u00fche korra v\u00f5i paaril korral m\u00f5juval p\u00f5hjusel, ei t\u00f5tta veel \u00fc\u00fcrileandja v\u00f5tma ette samme temast vabanemiseks. Ikka juhtub.<\/p><p>Kui aga on alust arvata, et probleem s\u00fcveneb, v\u00f5iks m\u00f5elda \u00fc\u00fcrilepingu \u00fcles \u00fctlemisele.<\/p><p>Kuidas saab seda teha?<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-229f676 elementor-widget elementor-widget-text-editor\" data-id=\"229f676\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><a href=\"https:\/\/www.riigiteataja.ee\/akt\/961235\" target=\"_blank\" rel=\"noopener\">V\u00f5la\u00f5igusseadus<\/a> n\u00e4eb ette kolm erinevat \u00fcles\u00fctlemise alust tasumisega viivitamise korral.<\/p><p><strong>Esiteks maksedistsipliini rikkumine<\/strong>.<\/p><p>See t\u00e4hendab, et \u00fc\u00fcrnik on tasunud lepingulisi makseid v\u00f5i nende osa kokkulepitud t\u00e4htajast hiljem ja seda v\u00e4hemalt kahel j\u00e4rjestikusel korral. Oluline osa on v\u00e4hemalt \u00fche kuu \u00fc\u00fcr, k\u00f5rvalkulud v\u00f5i hoone korrashoiu- ja parenduskulud.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d684bb3 elementor-widget elementor-widget-text-editor\" data-id=\"d684bb3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Teine \u00fcles\u00fctlemise alus<\/strong> on \u00fc\u00fcri v\u00f5i tagatisraha maksmata j\u00e4tmine.<\/p><p>Siin on juba oluline v\u00f5lgnetav summa. \u00dc\u00fcri v\u00f5i tagatisraha v\u00f5lgnevus peab olema v\u00e4hemalt <strong>kahe kuu<\/strong> eest, et leping \u00fcles \u00f6elda.<\/p><p>Ning <strong>kolmas alus<\/strong> tuleb k\u00f5ne alla siis, kui v\u00f5lgnetavad k\u00f5rvalkulud v\u00f5i hoone korrashoiu- ja parenduskulud \u00fcletavad kahe kuu eest maksmisele kuuluvad kulud.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48c603d elementor-widget elementor-widget-text-editor\" data-id=\"48c603d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Siiski vaatamata sellele, et \u00fcles\u00fctlemise alus on olemas, <strong>ei saa<\/strong> \u00fc\u00fcrileandja teha seda <strong>p\u00e4evapealt<\/strong>.<\/p><p>Nimelt tuleb \u00fc\u00fcrnikku enne lepingu \u00fcles\u00fctlemist <strong>hoiatada<\/strong>, et kui ta <strong>14 p\u00e4eva<\/strong> jooksul v\u00f5lgnevust ei kustuta, \u00f6eldakse temaga s\u00f5lmitud leping \u00fcles.<\/p><p>T\u00e4iendavat t\u00e4htaega ei ole vaja anda, kui \u00fc\u00fcrnik on v\u00f5lgnevusele eelnenud aasta jooksul v\u00e4hemalt kahel korral tasunud v\u00f5la alles t\u00e4iendava t\u00e4htaja jooksul v\u00f5i p\u00e4rast seda. Sellisel juhul v\u00f5ib lepingu koheselt \u00fcles \u00f6elda.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f222f6 elementor-widget elementor-widget-text-editor\" data-id=\"0f222f6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Lepingu \u00fcles\u00fctlemisest tuleb \u00fc\u00fcrnikule teatada <strong>taasesitamist v\u00f5imaldavas vormis<\/strong> (kirja, elektronposti, s\u00f5numi vms moel). Ning teates tuleb m\u00e4rkida v\u00e4hemalt:<\/p><ol><li>eluruumi aadress;<\/li><li>lepingu l\u00f5ppemise p\u00e4ev;<\/li><li>\u00fcles\u00fctlemise p\u00f5hjus;<\/li><li>\u00fcles\u00fctlemise vaidlustamise kord ja t\u00e4htaeg.<\/li><\/ol><p>NB! <strong>N\u00f5uetele mittevastav<\/strong> \u00fcles\u00fctlemine on t\u00fchine ning \u00fc\u00fcrnik v\u00f5ib j\u00e4tta selle t\u00e4helepanuta ja j\u00e4tkata asja kasutamist.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c59ba70 elementor-widget elementor-widget-text-editor\" data-id=\"c59ba70\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Eluruumi \u00fc\u00fcrnik v\u00f5ib lepingu \u00fcles\u00fctlemist vaidlustada <strong>30 p\u00e4eva<\/strong> jooksul <a href=\"https:\/\/www.tallinn.ee\/et\/tallinna-uurikomisjon\" target=\"_blank\" rel=\"noopener\">\u00fc\u00fcrikomisjonis<\/a> v\u00f5i kohtus ja seda vaid siis, kui \u00fcles\u00fctlemine on vastuolus <strong>hea usu p\u00f5him\u00f5ttega<\/strong>.<\/p><p>Paraku on Eestis vaid \u00fcks \u00fc\u00fcrikomisjon, mis asub Tallinnas ja kus lahendatakse vaid Tallinnas olevate eluruumide kasutamisega seotud vaidlusi.<\/p><p>Kui tegemist on v\u00e4ljaspool Tallinnat oleva eluruumiga v\u00f5i \u00e4ripinnaga, tuleb ette v\u00f5tta kohtutee.<\/p><p>\u00dc\u00fcrilepingu \u00fcles\u00fctlemine <strong>ei vabasta<\/strong> \u00fc\u00fcrnikku v\u00f5lgnevusest. Paraku, kui \u00fc\u00fcrnik vabatahtlikult v\u00f5lga ei kustuta, tuleb ikkagi p\u00f6\u00f6rduda \u00fc\u00fcrikomisjoni v\u00f5i kohtusse.<\/p><p>Ekslik on arvata, et \u00fc\u00fcrileandja peab ootama mingis suuruses v\u00f5i mingi perioodi jooksul \u00fc\u00fcriv\u00f5la tekkimist, et esitada \u00fc\u00fcrnikule n\u00f5ue.<\/p><p>Ei, igasugune kohustus tuleb t\u00e4ita kokkulepitud viisil ja \u00f5igel ajal. N\u00f5ue muutub sissen\u00f5utavaks alates ajahetkest, mil \u00fc\u00fcrileandjal on \u00f5igus n\u00f5uda n\u00f5uetele vastava kohustuse t\u00e4itmist.<\/p><p>N\u00e4iteks kui \u00fc\u00fcrnik peab \u00fc\u00fcri tasuma 15ndaks kuup\u00e4evaks, siis sellele t\u00e4htp\u00e4evale j\u00e4rgnevast p\u00e4evast ehk 16ndast kuup\u00e4evast alates on \u00fc\u00fcrileandjal \u00f5igus esitada \u00fc\u00fcrnikule lepingu t\u00e4itmise n\u00f5ue.<\/p><p>Koos lepingu t\u00e4itmise n\u00f5udega, peab \u00fc\u00fcrileandja andma \u00fc\u00fcrnikule <strong>m\u00f5istliku t\u00e4htaja<\/strong> v\u00f5la kustutamiseks. Alles seej\u00e4rel saab \u00fc\u00fcrileandja esitada avalduse \u00fc\u00fcrikomisjoni v\u00f5i hagi kohtusse.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-40934c0 elementor-widget elementor-widget-text-editor\" data-id=\"40934c0\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><a href=\"https:\/\/www.tallinn.ee\/et\/tallinna-uurikomisjon\" target=\"_blank\" rel=\"noopener\">\u00dc\u00fcrikomisjon<\/a> on alternatiivorgan eluruumi \u00fc\u00fcrivaidluste lahendamisel. Paraku on Eestis ainult \u00fcks \u00fc\u00fcrikomisjon, milleks on Tallinna \u00dc\u00fcrikomisjon. Seega saab \u00fc\u00fcrikomisjoni p\u00f6\u00f6rduda vaid siis, kui tegemist on Tallinnas asuva eluruumiga.<\/p><p>\u00dc\u00fcrikomisjoni p\u00e4devus rahaliste n\u00f5uete osas on piiratud <strong>3200 euroga<\/strong>. \u00dc\u00fcrikomisjonist on v\u00f5imalik otsus k\u00e4tte saada kohtumenetlusest oluliselt kiiremini.<\/p><p>\u00dc\u00fcrikomisjoni p\u00f6\u00f6rdumine on <strong>riigil\u00f5ivuvaba<\/strong> ja j\u00f5ustunud otsus on t\u00e4itmisele p\u00f6\u00f6ratav t\u00e4itemenetluse korras. V\u00e4ljaspool Tallinnat olevate eluruumide ja \u00e4riruumide korral, saab p\u00f6\u00f6rduda vaid kohtusse.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1715408 elementor-widget elementor-widget-text-editor\" data-id=\"1715408\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Kohtusse p\u00f6\u00f6rdumisel<\/strong> on m\u00f5istlik kasutada <strong><a href=\"https:\/\/www.kohus.ee\/kohtusse-poordujale\/tsiviilkohtumenetlus\/maksekasu-kiirmenetlus\" target=\"_blank\" rel=\"noopener\">maksek\u00e4su kiirmenetlust.<\/a> <\/strong><\/p><p>Kiirmenetlus v\u00f5imaldab \u00fc\u00fcrileandjal hagimenetlusest kiiremini, v\u00e4iksema t\u00f5endamiskoormuse ja v\u00e4iksemate kulutustega saada t\u00e4itedokument.<\/p><p>Maksek\u00e4su kiirmenetluse riigil\u00f5iv on <strong>3% n\u00f5udelt<\/strong> kuid mitte alla 45 euro ja sissen\u00f5utav v\u00f5lgnevus ei v\u00f5i \u00fcletada 6400 eurot. T\u00e4itedokumendi ehk maksek\u00e4su alusel saab kohtut\u00e4itur n\u00f5uda v\u00f5lgnevuse sisse t\u00e4itemenetluse korras.<\/p><p>Kui aga sissen\u00f5utav summa on k\u00f5rgem v\u00f5i \u00fc\u00fcrnik ei n\u00f5ustu \u00fc\u00fcrikomisjoni otsusega, v\u00f5i ei tunnista v\u00f5lgnevust maksek\u00e4su kiirmenetluses, tuleb algatada hagimenetlus maakohtus.<\/p><p>Siis aga tuleb tasuda t\u00e4ies mahus riigil\u00f5iv v\u00f5i maksek\u00e4su kiirmenetluse j\u00e4rgselt riigil\u00f5ivude vahe. J\u00f5ustunud kohtuotsuse p\u00f6\u00f6rab t\u00e4itmisele Sinu enda poolt valitud kohtut\u00e4itur.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2d0762a elementor-widget elementor-widget-text-editor\" data-id=\"2d0762a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Arvestada tuleb ka <strong>n\u00f5ude aegumisega.<\/strong><\/p><p>Kui \u00fc\u00fcrileandja n\u00f5uab \u00fc\u00fcritud asja muutmise v\u00f5i halvendamise eest h\u00fcvitist, on aegumist\u00e4htaeg <strong>kuus kuud.<\/strong> Aegumist\u00e4htaeg algab asja tagasisaamisest. Kui aga tegemist on \u00fc\u00fcri, k\u00f5rvalkulude ja\/v\u00f5i hoone korrashoiu- ja parenduskuludega, on aegumist\u00e4htaeg <strong>kolm aastat<\/strong>.<\/p><p>Aegumist\u00e4htaeg algab n\u00f5ude sissen\u00f5utavaks muutumisega.
