Paraku loodeti rohkemat aga saadi vaid pisku, kuid abiks seegi.<\/p><p>N\u00e4iteks lahendati aastaid vaidlust tekitav k\u00fcsimus \u2013 kas \u00fc\u00fcrniku kanda v\u00f5ib panna maksed korteri\u00fchistu remondifondi. T\u00e4na on see v\u00f5imalik, kuid teatud piirangutega. Eelk\u00f5ige ei t\u00e4henda see seda, et n\u00fc\u00fcd peavad automaatselt k\u00f5ik \u00fc\u00fcrnikud neid kulusid kandma, kui \u00fc\u00fcrilepingus on k\u00f5rvalkulude kokkulepe kirjas.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3c3c8e4 elementor-widget elementor-widget-text-editor\" data-id=\"3c3c8e4\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>K\u00f5igepelt <strong>k\u00f5rvalkuludest<\/strong>.<\/p><p>Enamasti on \u00fc\u00fcrilepingutes k\u00f5rvalkulude kandmise kohustus kirjas, kuid miks siis siia alla ei k\u00e4i <strong>remondifond<\/strong>? <a href=\"https:\/\/www.tallinn.ee\/et\/tallinna-uurikomisjon\" target=\"_blank\" rel=\"noopener\">\u00dc\u00fcrikomisjon<\/a> on p\u00f5hjust selgitanud j\u00e4rgmiselt:<\/p><p>\u201eKorteri\u00fchistu remondikulu ja sihtkulu ei koguta reeglina mitte igap\u00e4evase hoolduse tegemiseks, vaid enamasti perspektiivis \u00fchistu ees seisvate maja kasutamisj\u00e4rgses seisundi hoidmiseks p\u00fcstitatud eesm\u00e4rkide t\u00e4itmiseks, s.o on suunatud sellele, et teha edaspidi \u00fchistu poolt otsustatud suuremamahulisi plaanilisi remonte v\u00f5i likvideerida ootamatuid suuremahulisi avariisid n\u00e4iteks. Seet\u00f5ttu leiab komisjon, et remondikulu ja sihtkulu ei ole tasu, mis oleks m\u00e4\u00e4ratud \u00fc\u00fcrileandja v\u00f5i kolmanda isiku teenuse v\u00f5i tegude eest, mis on seotud asja igap\u00e4evase kasutamisega.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-229f676 elementor-widget elementor-widget-text-editor\" data-id=\"229f676\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Selguse m\u00f5ttes on t\u00e4na ka k\u00f5rvalkulude regulatsiooni t\u00e4iendatud klausliga, et k\u00f5rvalkulude kandmise kokkulepe ei seondu lepingueseme parendamise v\u00f5i selle puuduse k\u00f5rvaldamisega.<\/p><p>Lisaks otsustas seadusandja anda senisest suurema v\u00f5imaluse <strong>omavaheliste kokkulepete s\u00f5lmimiseks,<\/strong> t\u00e4iendades seadust paragrahviga, mis lubab kokku leppida, et \u00fc\u00fcrnik <strong>maksab<\/strong> ka remondifondi makseid.<\/p><p>Seadusandja nimetab neid kulusid hoone korrashoiu- ja parenduskuludeks.<\/p><p>Kuid sarnaselt k\u00f5rvalkuludega, peab \u00fc\u00fcrnik neid kandma vaid siis, kui selles on <strong>lepingu s\u00f5lmimisel kirjalikku taasesitamist v\u00f5imaldavas vormis kokku lepitud<\/strong>. Seega peab kokkulepe olema juba algselt, \u00fc\u00fcrilepingu s\u00f5lmimisel kirja pandud ja ei kandu automaatselt \u00fcle varasemalt s\u00f5lmitud \u00fc\u00fcrilepingutesse.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d684bb3 elementor-widget elementor-widget-text-editor\" data-id=\"d684bb3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Teiseks ei saa selles kokku leppida <strong>lepingu kestel<\/strong>.<\/p><p>Seega, kui pooled lepivad kokku, et \u00fc\u00fcrnik hakkab kanda hoone korrashoiu- ja parenduskulusid, tuleb k\u00f5igepealt olemasolev leping poolte kokkuleppel l\u00f5petada ja s\u00f5lmida uus leping uutel tingimustel.<\/p><p>Seda eelk\u00f5ige selleks, et \u00fc\u00fcrnik oskaks arvestada sellise lisakohustusega ning juba lepingut s\u00f5lmides vaagida, kas k\u00f5ikide maksete kogusumma ei \u00fcleta tema maksev\u00f5imekust.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-48c603d elementor-widget elementor-widget-text-editor\" data-id=\"48c603d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Oluline on ka n\u00f5ue, et <strong>hoone korrashoiu- ja parenduskulud oleksid m\u00f5istlikus, proportsionaalses ja etten\u00e4htavas ulatuses. <\/strong><\/p><p>Selline n\u00f5ue peaks kohustama \u00fc\u00fcrileandjat (aga ka \u00fc\u00fcrnikku) olema kursis korteri\u00fchistu kavandavate tegevustega v\u00e4hemalt \u00fc\u00fcriperioodil. V\u00f5imalike <strong>vaidluste ennetamiseks,<\/strong> v\u00f5iks lepingus v\u00e4lja kirjutada, mida need kulud sisaldavad ja millises suurusj\u00e4rgus need on.<\/p><p>Perioodilised maksed remondifondi ja korteri\u00fchistu v\u00f5etud laenumakse osa ei tohiks tekitada probleeme, k\u00fcll aga <strong>ei saa \u00fc\u00fcrniku kanda j\u00e4tta<\/strong> kogu maja ulatusliku renoveerimisega seotud kulusid. Kuna \u00fc\u00fcrnik kasutab \u00fc\u00fcrieset suhteliselt l\u00fchikese aja jooksul, peaks need kulud j\u00e4\u00e4ma ikkagi omaniku kanda.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f222f6 elementor-widget elementor-widget-text-editor\" data-id=\"0f222f6\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Samas <strong>t\u00f5stab<\/strong> maja renoveerimine omaniku <strong>vara v\u00e4\u00e4rtust<\/strong> ja kasutamise mugavust, mis omakorda v\u00f5imaldab k\u00fcsida k\u00f5rgemat \u00fc\u00fcri.<\/p><p>Paraku, kui pooled lepivad kokku, et \u00fc\u00fcrnik kannab terve hoone parendamiseks vajalikke kulusid, ei saa \u00fc\u00fcrileandja lepingu kestel \u00fc\u00fcri t\u00f5sta seoses parendustega, k\u00fcll aga uue lepingu
